Digital Product Passport for Construction Products

Regulatory position

The framework is law; the activation date follows a delegated act

Regulation (EU) 2024/3110 is in force and its Chapter X defines the construction DPP framework. The Commission must establish the system through an Article 75 delegated act.

Six months after that act enters into force, the system must be operational. The manufacturer obligation applies 18 months after the act enters into force. Until that trigger exists, manufacturers should avoid publishing an invented calendar deadline.

Construction products DPP FAQ

Is the construction products DPP already mandatory?

The Regulation is in force, but mandatory DPP use depends on the delegated act establishing the construction DPP system. The system becomes operational six months after that act enters into force, and the manufacturer obligation applies 18 months after it enters into force.

Is a construction DPP the same as an ESPR passport?

No. It is established under Regulation (EU) 2024/3110, but Article 75 requires it to be compatible with, interoperable with and based on the ESPR DPP architecture while also supporting construction-specific needs and BIM.

What must a construction product passport contain?

Article 76 identifies the declaration of performance and conformity, product and safety information, technical documentation, labels, unique identifiers, documentation required by other EU law and available data carriers for key parts.

Is the passport product-type or item-level?

The Regulation states that it corresponds to the product type and its unique identification code. Manufacturers may still need batch or item relationships operationally, but should not present item-level identity as the universal legal requirement.

How long must construction DPP information remain available?

The Article 75 system is to remain accessible for 25 years after the last product of the type is placed on the market, while the economic operator makes the passport available for at least 10 years, subject to the delegated system rules.

How should manufacturers prepare now?

Start with one product type, map declarations and technical evidence, establish persistent identity and source ownership, then test carrier access, permissions, BIM exchange, retention and reuse scenarios.
